Welcome to Lunapaw. These Terms of Service (“Terms”) govern your use of our website, products, and services made available through lunapawatelier.com (the “Site”).
By accessing or using our Site, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.
Throughout these Terms, “Lunapaw,” “we,” “us,” and “our” refer to Lunapaw Atelier.
1. Eligibility
By using this Site, you confirm that you are at least the age of majority in your country, state, or province of residence, or that you are using the Site under the supervision of a parent or legal guardian.
You agree to use this Site only for lawful purposes and in accordance with these Terms.
2. Products
We make every effort to ensure that all product descriptions, images, pricing, and other information on the Site are accurate. However, we do not guarantee that all information on the Site is complete, current, or error-free.
Because many Lunapaw products are handmade using natural materials, slight variations in color, texture, shape, stitching, finish, or other small details may occur. These natural and handmade variations are not considered defects and form part of the unique character of our products.
We reserve the right to modify, discontinue, update, or change products, pricing, descriptions, and availability at any time without prior notice.
3. Orders
All orders placed through the Site are subject to acceptance and availability.
After you place an order, you will receive an email confirming that we have received your order. This confirmation does not mean that your order has been accepted. A contract between you and Lunapaw is formed only when your order has been accepted and dispatched.
We reserve the right, at our sole discretion, to refuse, cancel, or limit any order, including where we suspect fraud, unauthorized activity, resale, pricing errors, or product unavailability.
4. Prices, VAT, Duties, and Payment
All prices displayed on the Site are shown in the applicable currency indicated at checkout.
Unless otherwise stated, prices displayed on the Site include VAT where applicable.
Shipping charges will be shown at checkout before you complete your purchase.
For international orders, customs duties, import taxes, clearance fees, and any other local charges are the responsibility of the customer, unless otherwise expressly stated on the Site.
Payment must be made in full at the time of purchase using one of the payment methods we make available on the Site. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.
We reserve the right to correct any pricing errors, inaccuracies, or omissions at any time, including after an order has been submitted.
5. Shipping and Delivery
We aim to process and dispatch orders within the timeframe stated on the Site or in your order confirmation. However, all delivery dates are estimates only and are not guaranteed.
We are not responsible for delays caused by shipping carriers, customs clearance, weather events, force majeure events, or other circumstances beyond our reasonable control.
Risk of loss or damage to products passes to you upon delivery to the address provided in your order, except where otherwise required by applicable consumer law.
It is your responsibility to ensure that your shipping information is accurate and complete. We are not responsible for delivery failures, delays, or losses resulting from incorrect or incomplete address details provided by you.
6. Returns, Refunds, Faulty Items, and Cancellations
Our Returns, Refunds, Faulty Items & Cancellations Policy forms part of these Terms.
By placing an order with us, you acknowledge that you have read and accepted that policy.
Nothing in these Terms limits any mandatory consumer rights you may have under applicable law. In Hong Kong, online traders remain subject to consumer protection rules, including laws addressing misleading trade practices and contractual protections in consumer transactions.
7. Incorrect, Missing, or Damaged Items
If you receive an incorrect item, a missing item, a seriously damaged item, or an item with a manufacturing defect, you must contact us within the timeframe stated in our applicable policy.
We may request supporting information, including your order number, proof of purchase, photographs, videos, and packaging details, in order to assess the issue and determine an appropriate resolution.
We reserve the right to decide, acting reasonably, whether an item qualifies for repair, replacement, refund, partial refund, or another appropriate remedy.
8. Cancellations
Orders may only be cancelled within the cancellation window stated in our cancellation policy.
Because certain handmade or made-to-order items may enter production shortly after purchase, we may be unable to cancel an order once production has begun.
If you would like to request a cancellation, please contact us as soon as possible at contact@lunapawatelier.com and include your order number.
9. Intellectual Property
All content on this Site, including but not limited to text, product names, branding, logos, graphics, photographs, videos, artwork, website design, icons, and other materials, is owned by or licensed to Lunapaw and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, display, publish, sell, license, create derivative works from, or otherwise exploit any part of the Site or its content without our prior written permission.
Use of our Site does not grant you any ownership rights in any intellectual property belonging to Lunapaw.
10. Acceptable Use
You agree not to:

We do not guarantee that the Site will be secure, error-free, uninterrupted, or free from viruses or other harmful components.
15. Limitation of Liability
To the fullest extent permitted by law, Lunapaw, its directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business, loss of data, or loss of goodwill, arising out of or related to your use of, or inability to use, the Site or any products purchased through it.
Our total liability to you for any claim arising out of or in connection with these Terms or your purchase of products from us shall not exceed the amount paid by you for the relevant product giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

17. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, supply chain disruptions, internet outages, pandemics, governmental action, or transportation delays.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region, unless mandatory consumer protection laws in your country of residence provide otherwise.
If you are a consumer residing in the United Kingdom, the European Union, the United States, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms affects any rights you may have under those laws that cannot be waived or limited by contract.
19. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
20. Waiver
No failure or delay by Lunapaw in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy.
